ASSUMPTION OF RISKS, RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY BEFORE SIGNING.

By signing this document, you will waive certain legal rights, including the right to sue.

TO: Konsolt.Beyond, Art Of 8 Martial Arts Academy, their agents, owners, officers, affiliates, volunteers, employees, participants, representatives, and any other individuals or entities acting on their behalf (collectively referred to as "Art Of 8 Martial Arts Academy").

IN CONSIDERATION of Art Of 8 Martial Arts Academy permitting the undersigned to participate in the martial arts of Muay Thai, Boxing, Kickboxing, Wrestling, Jiu Jitsu, Anti-Grappling, Yoga, Mixed Martial Arts, Fitness Training or any related activities (hereafter referred to as "the Activities"), the participant(s) agree as follows, on behalf of themselves and their respective spouse, children, parents, heirs, assigns, personal representatives, and estate:

Acknowledgment of Risks:

I understand that participation in the Activities entails both known and unknown risks that could result in physical injury, emotional injury, paralysis, death, or damage to myself, my family, heirs, assigns, property, or third parties. These risks cannot be entirely eliminated without compromising the essential nature of the Activities. I am voluntarily choosing to engage in the Activities despite these inherent risks.

Physical Condition and Consultation:

I am fully aware that the required physical exertion may be strenuous and cause physical injury, and I accept the risks and hazards involved. I affirm that my child(ren)/ward and I are in sufficient physical condition to participate in the Activities. If necessary, I will consult with a physician prior to participation to obtain confirmation that there are no medical conditions that would affect mine and/or my child(ren)/ward full participation in the Activities. I acknowledge that I am responsible for determining whether I, or my child(ren)/ward, are physically fit to engage in the Activities.

Assumption of Risk:

I accept full responsibility for any discomfort, illness, injury, or accident that may occur while preparing for, participating in, or traveling to and from the Activities. I further acknowledge the risks associated with transportation to and from Art Of 8 Martial Arts Academy, including potential accidents.

Insurance and Medical Expenses:

I acknowledge that my child(ren)/ward and I may require medical treatment if injured. I consent to medical care and transportation in order to obtain treatment in the event of injury and I understand that no medical care may be available, but if it is, I assume liability for any and all medical expenses incurred as a result of my participation in the Activities. I affirm that I have adequate personal insurance coverage to cover such medical expenses. I understand and agree that Art Of 8 Martial Arts Academy will not be liable for any medical costs (including but not limited to ambulance transport, hospital stays, physician, and pharmaceutical goods and services) incurred by me, or my child(ren)/ward.

I consent to emergency medical care and transportation, if necessary, and accept full responsibility for any medical expenses arising from such care. I acknowledge that this waiver extends to any liability connected with medical treatment or transportation required due to an emergency.

Release of Liability:

I hereby release and discharge, Art Of 8 Martial Arts Academy, its agents, officers, directors, employees, volunteers, and representatives from any and all claims, demands, actions, or causes of action for injury, loss, or damage to property or person, including death, arising from or related to my participation in the Activities, whether caused by negligence, gross negligence, or any other cause.

Indemnification:

I agree to indemnify and hold harmless Art Of 8 Martial Arts Academy, its directors, officers, instructors, staff, and all persons acting under its authority, from any and all claims, demands, causes of action, or liabilities, including but not limited to death, injury, damages, or loss to my person, my family, heirs, assigns, personal representatives, estate, or property of any kind. This indemnification applies regardless of the cause and arises from or is connected with my participation in the Activities.

I further agree to indemnify Art Of 8 Martial Arts Academy, its directors, officers, instructors, staff, and all persons acting under its authority for any legal fees incurred to enforce this agreement. I voluntarily release, remise, forever discharge, and agree to hold harmless Art Of 8 Martial Arts Academy from any and all claims, demands, or causes of action that I have or may have in the future. This includes releasing Art Of 8 Martial Arts Academy from any and all liability for any loss, damage, expense, or injury, including death, that I or my family, heirs, assigns, personal representatives, or estate may suffer or cause as a result of my participation in the Activities.

Compliance with Rules:

I agree to comply with all posted rules, instructions, and directions provided by Art Of 8 Martial Arts Academy. I understand that Art Of 8 Martial Arts Academy has the right to remove me and my child(ren)/ward from the Activities if they, in their sole discretion, determine that I or my child(ren)/ward are unable to safely participate in the Activities. I further understand and agree that I am expected to exhibit appropriate behaviour at all times while on the premises of Art Of 8 Martial Arts Academy and to obey all applicable laws while participating in or attending the Activities. This includes, respect for other people, equipment, facilities and property.

Personal Property:

I understand that I am solely responsible for my and my child(ren)/ward's personal belongings during participation in the Activities. Art Of 8 Martial Arts Academy is not liable for any lost, damaged, or stolen items.

Media Release:

I grant Art Of 8 Martial Arts Academy permission to photograph, videotape, or record mine and/or my child(ren)/ward's likeness, voice, and appearance for promotional, advertising, and educational purposes. I understand that I will not receive any compensation for the use of such media.

Consent:

I hereby represent and warrant that, in the event I am registering child(ren) under the age of 18 or an incapacitated adult, I am the parent or legal guardian of such individual(s) and possess the legal authority and capacity to enter into this Agreement and Waiver on their behalf. By proceeding with registration for the Activities, I acknowledge and agree that the terms and conditions of this Agreement and Waiver shall apply equally to all registered parties, including those under the age of 18 or incapacitated adults. I further affirm my acceptance of the contents of this Agreement and Waiver on behalf of the individual(s) under 18 years of age or incapacitated.

General Provisions:

I affirm that I have read and fully understand the terms and conditions of this Agreement. I certify that I have explained the policies/rules of Art Of 8 Martial Arts Academy to my child(ren)/ward. I understand that the rules established by Art Of 8 Martial Arts Academy have been implemented for the safety of all participants at Art Of 8 Martial Arts Academy, including myself and/or my child(ren)/ward. I further acknowledge that failure to comply with all rules, policies, and regulations established by Art Of 8 Martial Arts Academy may result in expulsion from the Activities. This Agreement is binding upon myself, my children, my heirs, assigns, and legal representatives.

Art Of 8 Martial Arts Academy agrees to provide, and the Student, , agrees to purchase competent instruction, supervised by qualified personnel trained in the procedures and traditions of such activities.

Payment Authorization & Responsibilities

EFT Authorization: I, , authorize Art Of 8 Martial Arts Academy to transfer electronic funds on an as needed basis from the checking, savings, or credit card account I specified above for purchases. This authorization is to remain effective until Art Of 8 Martial Arts Academy has collected for all charges assessed in connection with the terms and conditions of this Agreement.

Membership Term: This membership term is for a period of up to four (4) consecutive weeks under a one time payment structure. I understand that my membership benefits are exclusive to me and are in no way transferable to anyone else.

Member Acknowledgement:

Upon completion and full payment of any phase or program, students wishing to continue with the next phase or program must enter into a new membership and Agreement.
Art Of 8 Martial Arts Academy or any party designated by Art Of 8 Martial Arts Academy may photograph or film me while I attend the premises of Art Of 8 Martial Arts Academy and use of any and all such photos, video footage and/or video streaming for promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet.
The required physical exertion may be strenuous and cause physical injury, and I am fully aware of the risks and hazards involved. I hereby represent that I am physically fit to receive and participate in the prescribed course of instruction. I acknowledge that I have been advised to consult with a physician prior to and regarding my participation in the Classes and that my physician has confirmed to me that I have no medical condition which would affect my full participation in the Classes.
In consideration of my being permitted to participate in the Classes, I for myself, my heirs, executors, administrators, successors, and assigns and anyone else who may claim on my behalf hereby waive any and all claims, liability and damages I may now or in the future have against Art Of 8 Martial Arts Academy, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns, arising by any means whatsoever, including, but not limited to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused arising from or in connection with my participation in the Classes, however caused.
I further hereby release, remiss and forever discharge Art Of 8 Martial Arts Academy, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from and against all demands, claims, actions, damages, costs and expenses arising from or with respect to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused, arising from or in connection with my participation in the Classes whether or not caused by, in whole or in part, the negligence or gross negligence of Art Of 8 Martial Arts Academy.
I will hold harmless and indemnify Art Of 8 Martial Arts Academy, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from any and all liability for any damage or injury to the property or persons of any third party resulting from my involvement in or presence during any of the Classes.
I will comply with all the rules and regulations of Art Of 8 Martial Arts Academy.
I hereby agree that if Art Of 8 Martial Arts Academy, is unable to process my payment from the designated account provided by me, Art Of 8 Martial Arts Academy is permitted to use any of the other account information provided as many times and as often as needed to replace the unpaid payments and service charges as explained on section 9 of this agreement.
In addition to any rights and remedies it may otherwise have, Art Of 8 Martial Arts Academy may terminate this Agreement upon ten days' written notice to me if I fail to comply with my obligations under this Agreement and do not cure any such failure within ten days after receiving notice of such failure.
Failure to attend classes does not relieve me of my obligation to pay the full membership for the program or phase in which I am currently enrolled.
I understand that any missed sessions, within a particular week, cannot be rolled over/carried over into the following weeks/months.
Art Of 8 Martial Arts Academy in observance of all federal, provincial and territorial holidays will be closed on those designated dates.
I understand that make-up classes are only applicable if Art Of 8 Martial Arts Academy closes the the facility for reasons other than stated at item #12 above.
I understand that all membership changes, including notice of intent to cancel must be delivered to Art Of 8 Martial Arts Academy at least 3 business days BEFORE the next planned billing.
This notice must be submitted via registered mail (Unit G8A, 150 First Street, Orangeville ON L9W 3T7) or via email to memberships@artof8.com. I acknowledge that upon cancellation, I will no longer have access to classes beyond the last day of the month in which the cancellation is processed.
I confirm that the provisions in this agreement constitute the entire agreement between the parties hereto and supersede all prior communications, proposals, representations and agreements, whether oral or written with respect to the subject matter of this Agreement.
Art Of 8 Martial Arts Academy is committed to protecting the privacy of personal of our customers. We make every effort to ensure that the information you share with us is recorded accurately, retained securely and used only according to your wishes. We collect personal details necessary to communicate with you and manage our ongoing business relationship with you. If you have any questions about how your personal information is handled or distributed, or if you wish to receive a full copy of our full privacy policy, please contact our privacy officer.
I understand my rights and obligations as stated above. I confirm that I am the full age of nineteen years (unless otherwise indicated below) and that I have read and understood this release and waiver of liability and I am aware that by signing this agreement I am waiving certain legal rights, including the right to claim damages which I or my heirs, executors, administrators, successors or assigns may have against Art Of 8 Martial Arts Academy.
I may cancel this agreement within thirty-six (36) hours from 11/06/2025. You will receive a refund of the membership fee ($146.89) less an administrative fee of $50.00. I acknowledge that any clothing and/or gear that is received at signup cannot be returned and therefore, my signup/enrollment fees are non-refundable.
I acknowledge receiving a copy of this agreement.

You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, electronic mail, facsimile or personal written delivery. If you send the notice of cancellation by registered mail, electronic mail, or facsimile, it doesn't matter if the we receive the notice within the required period as long as you sent it within the required period. Also, Buyer or Buyer’s estate may cancel the agreement if (1) of the Buyer or Member dies, (2) the Member becomes totally physically disabled for the duration of the agreement, (3) our facilities are moved to a location that is more than twenty miles from the original facilities, (4) our services are no longer available as provided in the agreement because of a permanent discontinuance of operation.

UNIFORM POLICY

I understand team pride, equality and a positive culture of growth are important at Art Of 8 Martial Arts Academy. I understand and acknowledge that my academy uniform is MANDATORY and that I MUST wear my academy uniform to ALL classes. In limited circumstances, where this is not possible, I will communicate with the administration ahead of time.
